Wedge Co-Creation Pilot — E.ON UK plc

1.

Contractual Agreement

These terms and conditions apply in addition to our standard terms and conditions for residential customers.

We reserve the right to amend these terms and conditions at any time.

This document constitutes terms and conditions that are an agreement between you ("the Customer") and E.ON UK plc ("the Supplier") for the provision of the Wedge Co-Creation Pilot.

The Pilot has two phases:

  • Phase 1: Asset Connectivity and Data Collection - The objective of the phase is for us to learn how you use and optimise your energy assets and allow us to run simulations and analysis on the data from your assets.
  • Phase 2: Asset Steering and Optimisation - The objective of this phase is to learn how we can control, optimise and provide more value from your assets.

By participating in this pilot, the Customer assigns any IP rights in their feedback to the Supplier.

As the Customer, you will benefit from early access to Wedge products and services, direct influence on the product roadmap, and a role in helping us move towards a more sustainable future.

2.

Eligibility

To qualify for the Wedge Co-Creation Pilot, you must:

By agreeing to these terms you confirm you meet these eligibility criteria.

  • Own at least 2 energy assets (EV or EV charger, Heat Pump, Battery, Solar PV) that are capable of connecting through our third-party provider,  Enode;
  • Have installed a functioning Smart Meter capable of transmitting half-hourly usage data to us.

3.

Data Collection and Privacy

3.1

Processing your data

For the purpose of being part of this pilot, E.ON will be the 'data controller'.

This means E.ON UK Limited, and the companies owned by E.ON UK Limited who provide energy and related products and services. For further information on how we'll process your personal data please see our privacy notice (eonenergy.com/privacy) which we'll amend from time to time.

3.2

Your rights

You've a number of rights which relate to the access to and control of your data. These are also set out in our privacy notice. 

3.3

Telemetry and Usage Data

  • By signing this Contract, you consent to the collection of the following data from your smart meter;
    • use of half-hourly electricity and gas consumption data;
    • energy assets data; and
    • tariff information.
  • All personal data collected will be handled in accordance with applicable data protection legislation and the Supplier's Privacy Policy (https://www.eonenergy.com/privacy).
  • In addition, we may be required to share the following personal data with Enode and/or any third party to allow us to collect, analyse and manage your energy assets more effectively, which will be processed by them as a data controller:
      • Car make and model
      • Charger make and model
      • Battery make and model
      • Solar inverter details
      • Energy assets battery capacity
      • Your charging/storing preferences and schedules
      • Your timezone

All personal data collected will be handled in accordance with applicable data protection legislation and our Privacy Policy (https://www.eonenergy.com/privacy).

In addition, we may be requested to share the following personal data with Enode, to allow us to collect, analyse and control your energy asset data, which will be processed by them as a data controller:

  • Car make and model;
  • Charger make and model;
  • Battery make and model;
  • Solar inverter details;
  • Energy assets battery capacity;
  • Your charging/storing preferences and schedules;
  • Your timezone.

3.4

Enode

Enode helps energy companies easily connect with and manage home energy devices like electric cars, solar panels, and backup batteries through one simple system. As part of this Pilot we will use Enode to access your energy assets data. To be part of the Pilot you must agree with Enode’s privacy policy (https://enode.com/privacy-policy).

4.

Your responsibilities

Your responsibilities under this  Pilot are as follows;

  • You must take care of the meters at the property in accordance with your responsibilities under  the agreement  you have for the supply of electricity with your electricity supplier,
  • If you've got a smart meter, you must not let anything stop it from communicating with us.
  • You acknowledge and agree to connect your energy assets through the Enode platform and manage the connection to the best of your ability. To ensure proper functionality, you also agree to disable any overlapping or conflicting management features (such as scheduled charging) within your Original Equipment Manufacturer (OEM) or asset-specific applications including your vehicle, battery, or EV charger apps to allow Enode to manage your assets without interference.
  • If you fail to connect your energy assets though the Enode platform we reserve the right to notify you that you’re no longer eligible for the Pilot.
  • If you manually override or bypass the smart scheduling or energy events configured during the Pilot program, you acknowledge that you will forfeit any associated financial benefits or savings for that period. Furthermore, in such cases, you will be solely responsible for paying any standard tariff rates or energy charges billed by your utility provider. 

6.

Our Responsibilities

Under this  Pilot, we are not liable to you for;

  • any harm to you, which we couldn’t have expected when we agreed your Contract;
  • any loss or damage you suffer that’s outside our control, whatever caused it, to include any loss or damage, arising from normal wear and tear,  degradation of battery health resulting from the optimisation cycles performed during the Pilot, interruptions to your electricity supply, issues with smart charging, battery charging and heat pump heating schedule  functionality, including but not limited to, failure of your EV charger, battery charging, smart meter, network issues, or technical faults; and
  • The maximum we can pay in any one year (January to December) for any incident, or related series of incidents, is £1,000,000. That limit doesn’t apply if someone’s died or been injured, or if the law doesn’t limit liability. 

We are not responsible for increased energy costs incurred if you manually override the automated optimisation schedules or disconnect your assets.

6.

Payments under this Pilot

We will manage your connected energy assets with the objective of optimising performance, reducing your energy costs, or generating revenue. However, any projected savings or earnings are estimates only. We make no representations, warranties, or guarantees that you will achieve any specific financial benefit, cost reduction, or earnings, and such outcomes should not be relied upon.

If you qualify for any payments as a result of our optimisation activity then any payments we make back to you will be made via Direct Debit, and the Customer is responsible for ensuring that the Direct Debit mandate remains valid for the duration of your contract with us.

Your bill will be calculated based on actual energy usage as recorded by your smart meter. Any failure of the meter to transmit accurate data will result in estimated billing until the issue is resolved.

We will make any qualifying payment due back to you as a credit on your next bill within 1 month of termination.

7.

Termination and Exit

  • You may terminate your participation in the Wedge Co-Creation pilot at any time.
  • Upon termination, we will remove your assets from our analysis pool.
  • If we choose to terminate this Pilot, we will provide you with seven (7) days' written notice, remove your assets from the list of assets managed through Enode, and instruct Enode to remove your data from the pilot.

8.

Governing Law and Jurisdiction

These terms shall be governed by, and construed in accordance with, the laws of England and Wales.

Any disputes arising under or in connection with this contract shall be subject to the exclusive jurisdiction of the courts in England and Wales.

  • The maximum we can pay in any one year (January to December) for any incident, or related series of incidents, is £1,000,000. That limit doesn’t apply if someone’s died or been injured, or if the law doesn’t limit liability. 

We are not responsible for increased energy costs incurred if you manually override the automated optimisation schedules or disconnect your assets.
